Terms of Use

ScrollToll is a digital wellness application that helps users manage their screen time by requiring physical exercise to unlock access to selected applications on their device. The App uses AI-powered pose detection to track exercises and rewards users with screen time based on their physical activity.

Key features of the App include:

• App blocking and screen time management
• AI-powered exercise detection (push-ups, squats, sit-ups, overhead reaches)
• Memory tile games for cognitive exercise
• Step counter integration
• Earned screen time tracking and banking

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

3.1 Account Creation

You may be required to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Auto-Renewable Subscriptions

ScrollToll offers auto-renewable subscription plans that provide access to premium features. By subscribing, you agree to the following:

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscriptions by going to your account settings in the App Store or Google Play Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

3.3 Refunds

Refunds are subject to the policies of Apple (App Store) or Google (Google Play). We do not directly process refunds. Please contact the respective platform for refund requests.

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Modify, adapt, or create derivative works based on the App.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App.
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks.
• Attempt to gain unauthorised access to any part of the App or its related systems.
• Use automated scripts or bots to interact with the App.
• Circumvent or attempt to circumvent the app-blocking or exercise-detection features.

ScrollToll encourages physical activity but is not a medical or fitness application. Please note:

• Consult your doctor or healthcare provider before beginning any exercise programme, especially if you have any pre-existing medical conditions.
• Exercise at your own risk. We are not responsible for any injuries or health issues that may arise from performing exercises prompted by the App.
• The AI pose detection is provided for convenience and may not always be perfectly accurate. It should not be relied upon as a substitute for professional fitness guidance.
• Stop exercising immediately if you feel pain, dizziness, or discomfort.

All intellectual property rights in the App, including but not limited to the software, design, text, graphics, logos, icons, and content, are owned by BrainBox Automations or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in our Privacy Policy.

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, reliability, or completeness of any content or features provided through the App, including exercise detection and screen time tracking.

To the maximum extent permitted by applicable law, BrainBox Automations and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the App, regardless of the cause of action or the theory of liability.

In no event shall our total liability to you for all claims arising out of or related to the App exceed the amount you have paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless BrainBox Automations and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
